The rule of law is a perennial subject, many key aspects of which are being constantly contested. Meanwhile, it is currently facing serious challenges from populism, political polarization, authoritarianism, artificial intelligence, etc.
This special workshop will focus on the theory of the rule of law. The topics that will be investigated include:
The Generality of Law and the rule of law;
Law’s action-guiding function and the rule of law;
Law as integrity and the rule of law;
Basic equality and the rule of law;
The rule of law and individual rights;
Civil disobedience and the rule of law;
Civil procedure law and the rule of law;
The ignorance of law and the rule of law;
The principle of proportionality and the rule of law;
Multiculturalism and the rule of law;
The rule of law in the digital age;
The rule of law and the rule by law;
The rule of law and the excellence of law;
The theories of the rule of/by law of Han Feizi, HLA Hart, Lon Fuller, Ronald Dworkin, Joseph Raz, Gerald Postema, Jeremy Waldron, and Scott Shapiro.
