Varieties of Legal Realism – Methodological Perspectives for a True General Theory of Law?

Legal Realism is a theory, movement and practice that developed in different directions. We can include a variety of methods, approaches and inspirations under its umbrella, which consequently means that different terms are used to denote the field. Specifically, we encounter American Legal Realism, Scandinavian Legal Realism, Sociological Jurisprudence, Critical Legal Studies, Economic Analysis of Law, Socio-Legal Theory, Socio-Legal Positivism, Law-and-Society approach, and finally Realist Theory of Law.

Legal Realism approaches aim to, inter alia, better explain law as a social phenomenon by applying methods and results of social and natural sciences. If we accept the thesis that law has a dual nature – normative and sociological – Legal Realism aims to contribute to a better understanding of both aspects of its nature, using different methods.
In this light, the workshop aims to encompass and address the following topics:
1. Experimental philosophy, legal realism and methodology of law;
2. The position and significance of naturalisation in law as an improvement of methodology and understanding of law;
3. Neuroscience, naturalisation and legal concepts;
4. Sociological theory and the empirical – influence on new legal realism;
5. Legal realism as naturalistic approach to law.

All interested applicants are invited to send an abstract (max. 500 words) and a brief academic CV (under 200 words), written in English, by January 15th, 2024 (early booking registration) and fill out the registration form provided in the IVR 2024 website according to the schedule provided by the Conference Organizing Committee. For non-early booking registrations, a second round for submissions will remain open from January 16th until April 10th, 2024.
